By accessing or using the qaws or qaws.ai. platform (the "Platform"), you acknowledge and agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any provision of these terms, you may not access or use the Platform. These Terms and Conditions constitute a legally binding agreement between you and qaws or qaws.ai.

Data Usage

Candidate Data: You acknowledge and consent to the collection, use, processing, and potential disclosure of any data you provide to the Platform, including but not limited to personal information, educational and professional history, assessment results, and interview recordings. This data may be utilized by qaws for various purposes, including, but not limited to, service provision, verification and assessment procedures, candidate matching with potential employers, marketing and promotional initiatives, research and analysis, and any other purposes deemed necessary or appropriate by qaws or qaws.ai. Company Data: Similarly, you acknowledge and consent to the collection, use, processing, and potential disclosure of any data provided by companies, including company information, hiring preferences, and any other data deemed relevant by qaws or qaws.ai. This data may be used for purposes similar to those outlined for Candidate Data, as well as for any other purposes deemed necessary or appropriate by qaws or qaws.ai. General Data: You acknowledge and consent to the collection, use, processing, and potential disclosure of any data generated through your interaction with the Platform, including website traffic, usage patterns, and any other data deemed relevant by qaws or qaws.ai. This data may be used for purposes similar to those outlined for Candidate Data and Company Data, as well as for any other purposes deemed necessary or appropriate by qaws or qaws.ai.

Data Security and Privacy

While qaws or qaws.ai employs commercially reasonable security measures to protect your data, you acknowledge that no method of transmission over the Internet or method of electronic storage is entirely secure. qaws or qaws.ai makes no warranties or guarantees regarding the absolute security of your data and shall not be liable for any unauthorized access, use, or disclosure. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

Intellectual Property

All intellectual property rights in and to the Platform, including but not limited to copyrights, trademarks, and trade secrets, are and shall remain the exclusive property of qaws or qaws.ai and its licensors. You agree not to infringe upon or violate any of these intellectual property rights.

Disclaimer and Limitation of Liability

The Platform is provided "as is" and "as available" without any warranties, express or implied. qaws or qaws.ai disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. qaws or qaws.ai shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, even if qaws or qaws.ai has been advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold harmless qaws or qaws.ai and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or related to your use of the Platform or your breach of these Terms and Conditions.

Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of Saudi Arabia, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Saudi Arabia.

Entire Agreement and Amendments

These Terms and Conditions constitute the entire agreement between you and qaws or qaws.ai relating to the subject matter herein and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written. qaws or qaws.ai reserves the right to amend these Terms and Conditions at any time in its sole discretion. Any such amendments shall be effective immediately upon posting on the Platform. Your continued use of the Platform following the posting of any amendments constitutes your acceptance of such amendments.

Severability

If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck from these Terms and Conditions and the remaining provisions shall remain in full force and effect.

Waiver

No waiver of any provision of these Terms and Conditions shall be effective unless in writing and signed by an authorized representative of qaws or qaws.ai. or to such other address as either party may designate in writing from time to time.

Force Majeure

qaws or qaws.ai. shall not be liable for any delay or failure to perform its obligations hereunder due to any cause beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

Relationship of the Parties

Nothing in these Terms and Conditions shall be construed to create a partnership, joint venture, agency, or employment relationship between you and qaws or qaws.ai

Assignment

You may not assign or transfer these Terms and Conditions or any of your rights or obligations hereunder without the prior written consent of qaws or qaws.ai. may assign or transfer these Terms and Conditions or any of its rights or obligations hereunder without your consent.

Survival

The provisions of Sections 2 (Data Usage), 3 (Data Security and Privacy), 4 (Intellectual Property), 5 (Disclaimer and Limitation of Liability), 6 (Indemnification), 7 (Governing Law and Dispute Resolution), 8 (Entire Agreement and Amendments), 9 (Severability), 10 (Waiver), 11 (Force Majeure), 12 (Relationship of the Parties), 13 (Assignment), and 14 (Survival) shall survive any termination or expiration of these Terms and Conditions.
